Agreement

The person(s) whose signature(s) appear on this contract, known as “Client”, agrees that Nottingham Family Photographer Marta Szulc known as “Photographer”, shall provide services to photograph their photo session to the best of her abilities, in the manner described in this document. This is a binding contract which incorporates the entire understanding of the parties. Any modifications must be in writing, signed by both parties, and physically attached to the original agreement. The client assumes responsibility for all collection costs and legal fees incurred should enforcement of this contract is broken.

Liability

If Photographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, accident, illness or technical problems and she cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to the Client, and Photographer shall have no further liability concerning this agreement.

Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.

Booking Fee/Payment

At the time of the booking, the Client agrees to pay a non-refundable amount of £20/£40 to secure the session date. The Booking Fee amount will not be applied towards the Package Fee.

The client agrees to pay the final amount due the photoshoot day before the session. Photographer agrees to provide Package Fee details before signing this document.

LATE ARRIVAL

If the client is up to 15 minutes late for the session, the client can choose to take pictures for the remaining time.

However, if the client is more than 15 minutes late for the session, it will be considered a NO SHOW. A refund or rescheduling will not be available. The client will need to book a new session to get a new date.

If the session is completely missed, it would be considered a NO SHOW and no refund/ rescheduling will be provided.

Rescheduling

If the Client requests to reschedule a session, the retainer shall be applied to a rescheduled session if notice is given at least 5 days before the scheduled event. Reschedule must be within the same calendar year.

The Client is allowed to reschedule the session once. Rescheduling due to the weather does not count toward this limit.

CANCELLATION POLICY

If cancellation is initiated by the Photographer, all money including the deposit fee will be returned within 5 business days from the time of cancellation.

If the client cancels this agreement or fails to show, 5 or fewer calendar days before the session date, the retainer shall be forfeited. The client understands and agrees that Photographer will not book other sessions during this time. In the event that the Client cancels or fails to attend the session date, for any reason, Photographer shall suffer losses that are difficult to ascertain.

travel fee

Photographer agrees to perform photography services within 15 amount of miles of Eastwood. Any mileage above 15 miles will be charged at £1 per mile.

IMAGE ARCHIVE

All images will be available for purchase and/or download for I month following the session date.

The client is responsible for downloading their images in a timely manner.

The Photographer cannot guarantee the images will be kept beyond a 12-month period.

LIABILITY Waiver

This agreement is between_________________(Client Name) hereafter will be the Client

and the photographer Marta Szulc hereafter will be the photographer.

By agreeing to a photography session with Nottingham Family Photographer, I am hereby waiving, releasing, and discharging Nottingham Family Photographer and all its affiliates, from any liability, including but not limited to, liability arising from the negligence or the fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my travelling to and from this event.

Nottingham Family Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and themselves and release the photographer from any claims against their person or their business. The client swears that each person is participating voluntarily in the said photography session and forfeit all rights to bring a suit against Marta Szulc or Nottingham Family Photographer for any reason.

Nottingham Family Photographer is not responsible for uncooperative parties. le is understood that the behaviour of children is unpredictable, however, the photographer is not liable if children do not cooperate during sessions.
